Filing a domain name

Important !
The registration of a domain name is made by some clicks. Then a heavy investment follows : creation of a site, referencing the site so that people know you on the web... However the domain name gives you an acces not a right.
We take action in order to prevent you to be an infringer of a French or foreign mark, or to restrict the risks of that, and to allow you to obtain a mark right at the same time as a domain name.



What for a domain name ?

The first question is the domain level

* The international terminaisons in .com, .net, .org, .biz (from June 25, 2001), .info (from July 26, 2001)... can be filed without any justification, but they are very solicited andtherefore can be already filed.

* The national terminaisons (.fr for France, .it for Italy ...) locate you, but are sometimes more regularized. For the .fr, you have to justify your address in France.

It also exists a second level, as .com.fr, .co.uk, .tm.fr ....

It is often recommended to file both .com and .fr or .tm.fr in order to prevent a competitor to file it, bona fide or not.

The second question is about the name itself

For the .tm.fr or .fr, no modification is possible with regard to the justification. For example, in order to file a .tm.fr domain name, one has to provide the application or the registration of a mark that contains the whole domain name. As from November 19, 2001 it is possible to file a .fr corresponding to a French registered trademark.

But it can happen the domain name being already filed, for example by the titular of an identical mark, filed for different goods and/or services. An identical research is done for free by many sites. You should search within the domain names containing the one you wish, with all the terminaisons (these sites will be found by search engines and it is important not to be "drown" in a list of sites having a too close name...)

It can be interesting to choose a .com name that defines the activity domaine, while being easy to retain or find (e.g. : activitydomaine-mark.com). This domain name will have the other advantage of being cited by the search engines when the activity domaine is entered as key-word.

It is also possible to register a domain name in .nom.fr (i.e. ".name.fr") for a person or a .com.fr. One has then to produce some relevant documents according to the geographic localisation (for the .fr), but the choice of the domain name is free.
