Indications relating to the products and/or the services to which the mark shall apply
A French trademark can designate goods and/or services in more than one class of the International Classification under Nice Agreement.
Particulars relating to the mark
(a) Word mark: please indicate the vocable (it will be typed in block capitals)
(b) Graphic mark and/or mark accompanied by a logo: please forward us by post six copies of the reproduction of the mark (maximum size of the reproduction : 8 x 8 cm) : five copies for the filing properly speaking and one for our file ; or forward us by e-mail a document of the .jpg or .gif type.
(c) Claiming of color(s): It is possible to claim colors, by their arrangement, their combination or their shade (or hue). In the case of a sole colour, it is recommended to claim a color by its code such as " Pantone pink 219 ", rather than by its description such as "fuchsia pink" which may be considered as invalid.
(d) Sound mark: the mark must be graphically represented (a stave, a spectrum..). It is possible to precise for example the used instruments or to describe the sound (for example : the roaring of a lion).
(e) Three-dimensional mark: a planar representation is necessary (photograph, synthesis picture...). It is possible to describe the part of the form which does not appear on the representation.
(f) Hologram: we have to represent in the frame one or more representation(s) and not the hologram itself. It is possible to describe the sequence of pictures for example.
(g) T ransliteration: it is compulsory to transcribe into Latin alphabet, into Roman or Arabic figures the indications which are reproduced in other alphabets or characters (ideograms, Cyrillic script, Arab script...)
Particulars relating to the priority (if claimed)
A mark already filed abroad can be filed in France with claiming the date of the basic foreign filing, if the French filing is done within a six-month period as from such basic filing date (Art. R. 712-4).
Please forward us an official copy of the priority document; the latter can be still validly filed within a three-month period from the French filing.
If this priority document is not in French language, we shall translate it. If necessary, we shall ask you an English version in order to make the said translation easier.
If the priority document is in the name of another person, an assignation of the priority rights is requested together with its French translation. A simplified form can be filed ; do not hesitate to ask it.
Power of Attorney
No power of attorney is needed for the filing.
