Renewing a French trademark

Required information for the renewal

  • the trademark : number, sign and filing date ;
  • the owner;
  • when it occurs, indication of a partial renunciation, nullity, forfeiture or decision relating to the registration
  • indication of the international classes concerned by the renewal (all initial classes or only a part)
  • some goods and/or services may not be renewed; in such a case we need to know the list of goods and/or services which shall be renewed
  • when the new edition of the Nice Classification applies to the designated goods (in particular for services of former class 42), the French Office shall reclassify the goods and services without payment of new fees

New trademark application

When renewing a trademark it is possible to file at the same time a new application in order to designate supplementary goods and/or services or to slightly amend a figurative mark. It is then possible to combine the new application and the renewal so as only one renewal shall be necessary in the future.

Current Practice of the French Trademark Office for French Trademarks Renewals

According to the current practice of the French Trademark Office, the renewal request has to be filed in the name of the holder registered in the French Trademark Register at the time of filing the renewal request.

Where a transfer was registered in the French Trademark Register, a renewal request filed in the name of the prior holder will cause the French Trademark Office to issue for the renewal a decision of inadmissibility against which no appeal can be filed.

Where a transfer was not registered in the French Trademark Register, a renewal request filed in the name of the new holder will cause the French Trademark Office to issue for the renewal a decision of inadmissibility against which no appeal can be filed.

Where a change of name/address/legal form was registered in the French Trademark Register, a renewal request filed with the prior name/address/legal form of the holder will have to be corrected by filing a request for correction (Official fee 26 EUR).

Where a change of name/address/legal form was not registered in the French Trademark Register, a renewal request filed with the new name/address/legal form of the holder will cause the French Trademark Office to request proof of the change (no official fee). Thereafter, the change of name/address/legal form will have to be registered in the French Trademark Register (no official fee).
