The French patent office decided to offer a procedure to grant applications for an anti-COVID treatment or device or a device participating to the diagnostic or treatment of COVID-19 within 24 months from filing.
This will apply to (patent or certificate of utility) applications filed as from June 1st, 2020. This does not apply to provisional applications.
The request for such accelerated prosecution should be filed within 10 months from filing date of the French application.
The treatments, devices or diagnostics should have been submitted to a competent authority for marketing authorization before filing the request for accelerated prosecution.
