In a recent decision dated February 6, 2019, concerning the French part of European patent EP1180186, the French Supreme Court reaffirmed that in France, there cannot be an infringement under the doctrine of equivalents when the patented means have a known function, the function of the means being defined as the action to produce, in the application given to the means, a first technical effect.
