International Transfer of Technology

27.02.2009

Article 19 of the Decree 2008-1472 of 30/12/2008 abrogates Articles R624.1 to R624-7 of the French Intellectual Property Code, which gave the legal frame on the International Transfers of Technology.

An international transfer of technology takes place when a natural or legal person having his place of residence or business in France acquires industrial property rights from a natural or legal person having his place of residence or business abroad, or when a natural or legal person having his place of residence or business in France transfers industrial property rights to a natural or legal person having his place of residence or business abroad.Due to the abrogation of the above articles, these international transfers of technology do not have anymore to be declared to the National Institute of Industrial Property. The obligation to address annual statements to the National Institute of Industrial Property relating to these international transfers also does not exist anymore. This considerably simplifies these International Transfers of Technology.
