New Nice Classification : 9th Edition of the Trademarks International Classification

The new edition of Nice Classification is in force as from January 1st, 2007



Some modifications to be notedThere is no more distinction between products which are made of precious metals and products which are not made of precious metals : only the purpose of the product is considered. For example, table cutlery are in class 8 (Hand tools and implements (hand-operated); cutlery; side arms; razors), whether they are or not made of precious metals.The products which remain classified based on their material are the statues or statuettes, the figurines and the boxes. These products may be in the class 6 (Common metals and their alloys...), 14 (Precious metals and their alloys ...), 16 (Paper, cardboard and goods made from these materials...), 19 (Building materials (non-metallic)...), 20 (Furniture, mirrors, picture frames; goods (not included in other classes) of wood, cork, reed, cane, wicker, horn, bone, ivory, whalebone, shell, amber, mother-of-pearl, meerschaum and substitutes for all these materials, or of plastics) or 21 (... glassware, porcelain and earthenware not included in other classes).The legal services are moved from class 42 (Scientific and technological services and research and design relating thereto; industrial analysis and research services; design and development of computer hardware and software) to class 45 (Legal services; security services for the protection of property and individuals; personal and social services rendered by others to meet the needs of individuals).The services of "retail sale" must be formulated "gathering for account of a third part of product (a list or family of products must be indicated)".Date of applicationFiling : for an application for a French trademark, a Community trademark or an International trademark, the 9th classification is applicable for all applications having a date of filing from 01/01/2007, whether a priority is claimed or not.In case of a post designation for an International trademark, the applicable classification is the one corresponding to the date of filing of the basic application.RenewalOn the occasion of a French trademark renewal done on or after 01/01/2007, the INPI shall reclassifiy the goods and services without payment of new fees.On the occasion of an international trademark renewal, the WIPO shall not reclassify the trademarks.On the occasion of a Community trademark renewal, the OAMI shall not reclassify the trademarks.
