New Nice Classification: 10th Edition of the Trademarks International Classification

The new edition of Nice Classification will enter in force as from 1 January 2013.

Some modifications to be noted

Date of application

Filing : for an application for a French trademark, a Community trademark or an International trademark, the 10th classification is applicable for all applications having a date of filing from 01/01/2013, whether a priority is claimed or not.

In case of a post designation for an International trademark, the applicable classification is the one corresponding to the date of filing of the basic application.

Renewal

On the occasion of a French trademark renewal done on or after 01/01/2013, the INPI shall reclassifiy the goods and services without payment of new fees.

On the occasion of an international trademark renewal, the WIPO shall not reclassify the trademarks.

On the occasion of a Community trademark renewal, the OAMI shall not reclassify the trademarks.

Another important change affects the frequency of updates to the Nice Classification. Currently, updates occur every five years. From 1 January 2013, the Nice Classification will be updated annually. These annual updates will only include minor changes, such as additions, deletions and updates to items within a class. Substantive changes, such as class transfers, the creation of new classes and deletions of classes, will continue to be implemented every five years.
