The European Commission recently sent a notice (<link https: ec.europa.eu docsroom documents external-link-new-window internal link in current>ec.europa.eu/docsroom/documents/26683) to holders of and applicants for European Union trade marks (EUTM) and Community designs (RCD), pointing out that Brexit is normally to enter into effect on March 30, 2019.
Unless a withdrawal agreement is reached and contains a transitional agreement, as of the withdrawal date, EU rules on EU trade marks and Community designs will no longer apply to the United Kingdom.
The European Commission reminds that holders and applicants of EUTMs and RCDs should prepare for the withdrawal. In particular, in view of uncertainties as to the conclusion of a transitional agreement, measures to apply for UK trademarks and designs could be contemplated.
